Investigation 13 Decision issued Print E-mail

The Information Commissioner, Jennifer Dilbert, released the Decision on Investigation 13 involving The Ministry for Financial Services.  This was in regards to a request made for personnel information, the Ministry of Finance did not provide an initial decision nor an internal review, as required by the law.

Information Commissioner upholds Governor's Office decision to withhold budget documents 

  Information Commissioner Mrs. Jennifer Dilbert issued Decision 28 under the Freedom of Information Law, 2007 on Tuesday 5 March 2013. 

 In August 2012 an applicant made a request to the Governor's Office and the Ministry of Finance for records relating to the 2012 Cayman Islands budget negotiations. 

 The Commissioner found that the responsive records are exempt from disclosure under section 20(1)(b) of the Freedom of Information Law, 2007 and that it is not in the public interest to disclose the records.

 Under section 43(3)(a), the Commissioner states, "I uphold the decision of the Governor's Office to withhold the responsive records in the Hearing and do not require the Governor's Office to disclose the records."

Investigation 14 Decision issued. Print E-mail

Deputy Information Commissioner Jan Liebaers released the Decision on Investigation 14 involving the Ministry of Tourism & Development and the Computer Services Department, dated 1 March 2013. This was in regards to an FOI request for records contained in an inactive email account.

Information Commissioner issues Decision 27 involving PSPB Print E-mail

Information Commissioner Mrs. Jennifer Dilbert released Decision 27 under the Freedom of Information Law 2007, on Monday 21 January 2013.

The Public Service Pensions Board withheld some records and redacted information from others pertaining to the Applicant’s pension benefits. The Applicant appealed the matter to the Information Commissioner’s Office (ICO), and following the ICO’s investigation and recommendations, further records were provided to the Applicant, but some remained withheld or redacted. The Public Service Pensions Board claimed exemptions in sections 17(a) and 23(1) of the FOI law, relating to legal professional privilege and personal information.

The Information Commissioner upheld the decision of the Public Service Pensions Board to withhold responsive records that were memorandums from legal professionals to their clients consisting of legal advice, and ordered the disclosure of others. She agreed to some but not all of the redactions made by the Public Service Pensions Board pertaining to the personal information of a third party.

Disclosure of Port Authority records no longer required by Applicant Print E-mail

After receiving notification from the applicant that they no longer required the records considered in hearing 19, the Information Commissioner, Mrs. Jennifer Dilbert, has confirmed that she would not be certifying to the Grand Court the failure of the Port Authority to disclose the records pursuant to section 48 of the Freedom of Information Law, 2007.

Judicial Administration record not exempt under FOI Print E-mail

The Information Commissioner Mrs. Jennifer Dilbert has ordered the Judicial Administration to release a record that it sought to withhold from an applicant under the provisions of the Freedom of Information Law, 2007. Read more here.

 
FOI Commissioner overturns RCIPS decision and requires further action Print E-mail

The Information Commissioner Mrs. Jennifer Dilbert has overturned a decision of the Royal Cayman Islands Police Service (RCIPS) to refuse access to records requested under the Freedom of Information Law. Due to a number of procedural and administrative failures, the Commissioner found that the RCIPS was not in compliance with the FOI Law and required them to take actions to correct their deficiencies. FOI Commissioner finds National Pension Office non-compliant Print E-mail

In her most recent decision, the Information Commissioner Mrs. Jennifer Dilbert, did not make a formal ruling on whether access should be granted to an applicant, but due to a number of procedural issues has instead ordered the Chief Officer of the National Pensions Office (NPO) to re-examine the records and take steps to bring the authority into compliance with the FOI Law. Un-awarded financial tendering bids exempt from disclosure under FOI Print E-mail

The Information Commissioner recently released her 15th Decision in which she upheld the Ministry of Finance, Tourism and Development’s decision to exempt records from disclosure under section 17(b)(i) of the Freedom of Information Law. The records at issue in the matter pertained to the Government’s tender for long-term financing conducted in July 2010. The tender under review ended without the naming of a successful bidder. It was later reissued and awarded to the Cohen and Cohen group. Read More Here
