Registration Process and Fees
The state processes the fictitious name registration forms in approximately one week and sends back the filed documents in another week. Any errors in the forms that result in a rejection will prolong the process by at least several weeks. Publishing takes approximately two weeks.
To register a fictitious name with the state of Pennsylvania, you can either file online with the PENN File website or complete the Registration of Fictitious Name form. The filing fee is $70 for both Fictitious Name Registration and any ancillary transaction.
If you will be operating your sole proprietorship under a name different from your own, you need to file an Application for Registration of Fictitious Name with the Pennsylvania Department of State ($70). You can do this online using the PA Business One-Stop Shop or download the form and mail it to the Department of State.
Registering Online or by Mail
When preparing the Application for Registration of Fictitious Name (Form 311), ensure the proposed name is unique by performing a name availability search. Form 311 will require the following:
- A brief statement of the business activity.
- Legal name and address.
- Desired fictitious business name.
- Brief description of the nature of your business.
Note that DBAs help establish branding and separate liability for your business.
Additional Information and Advertising
- It typically takes 7-10 business days to get your DBA name registered in Pennsylvania.
- After approval, advertise within 30 days and pay taxes by the 15th of the 4th month.
Remember to add or change a word in your fictitious name if it’s too similar to another registered name to ensure uniqueness and compliance with state requirements.
