Do I Need CLP to Be a Legal Advisor?

Legal Advisor Requirements

No CLP is needed to be a legal advisor. Legal advisors have the same requirements as advocates and attorneys.

CLP Course Updates

The CLP needs updating to match local law degrees’ final year courses for legal officers. Areas like human rights, international trade and finance, public and private law should be added.

Client Legal Privilege

Client legal privilege protects lawyer-client confidentiality. It belongs to the client, not the lawyer. A lawyer can only disclose with client approval. Its chief purpose is to aid justice.

CLP Agreement

A CLP agreement outlines confidentiality, licensing, and rights terms between parties. It is used in technology transfers, joint ventures, and mergers.

Legal Professional Privilege (LPP)

LPP protects lawyer-client communications made to seek or give legal advice. A communication must be confidential, in a lawyer-client relationship, and for legal advice or proceedings to have LPP.

REACH and CLP Laws

REACH and CLP are independent EU chemicals laws. CLP labelling is legally required for selling candles and wax melts in the UK and EU. Medicines are exempt if finished. Labels need hazard communication. CLP replaced earlier directives.

CLP Exam

To take the CLP exam, three years legal experience is necessitated. Partial waivers are conceivable. NALS membership is not compulsory.

Legal Practice in Malaysia

Can I be a lawyer without CLP in Malaysia?

To be a lawyer in Malaysia, graduates need a law degree and must pass the Certificate in Legal Practice (CLP) exam. Some local universities like the University of Malaya are exempted from the CLP. After getting the law degree, exempted graduates can apply directly to the Bar.

The CLP is a professional certificate for law graduates to qualify as lawyers. It is the most stressful year. The exam has a written test on legal principles and a practical test on applying principles.

Law graduates have two options to advance their legal education – the Bar Professional Training Course (BPTC) in the UK or the local CLP. After completing either, they undergo a 9-month pupillage internship before being admitted to the Bar.

Legal Practice Qualifications

To be a "Qualified Person" under Malaysia’s Legal Profession Act, one needs the right qualifications. Passing the CLP or BPTC and completing pupillage are avenues to be "called to the Bar." Passing the CLP alone does not permit practice yet.

Foreign Lawyers in Malaysia

Foreign lawyers can register and be employed by Malaysian firms under a 3-year licence. UK barristers who did the BPTC can also practice in Malaysia subject to admission requirements.

Admission to the Bar in Malaysia

Upon completing pupillage, advocates are admitted to the Bar and become qualified lawyers. CLP exam and pupillage are not required for University of Malaya law graduates to practice. Credit in BM at the SPM level is compulsory to practice law in Malaysia.
