Deck Construction Regulations
Regardless of deck height, you can’t build within 10 feet of the rear border or 5 feet of side borders. A deck must maintain a 3-foot setback from any property line and project no more than 6 feet from the supporting wall. You need a permit for any deck higher than 30 inches off the ground. All you need are a pencil, ruler and graph paper. Draw your deck to scale (typically 1/4" per foot). You’ll need a site plan, plan view, elevations and complex part details.

How Close to a Fence Can I Build My Deck? Building codes require three feet between a deck and boundary. Most codes stipulate no more than five inches between railings and posts to prevent accidents.
Building Permits and Regulations
Compliance for decks and other structures depends on property lines and jurisdiction setbacks. Decks on boundaries need written neighbor approval for a Permitted Boundary Activity. Consent is required if the decking height equals or exceeds 500mm from ground level or exceeds 2.4m height. The area must also be further than 900mm from the property line.
