Hirer’s Responsibilities
The hirer must provide for safe custody as it is a strict liability obligation. Most agreements stipulate places where goods are kept and uses to prevent breach of terms enabling damage claims.
Moreover, the hirer must take reasonable care of goods although not liable for loss/damage without negligence. If goods perish without fault, subject to express terms, the agreement will discharge.
The hirer must pay instalments when due. If terminated before the purchase option is exercised, instalments to date must still be paid. Title stays with owner, and hirer only has rights as a bailee.
